US Justice Department looking to prorogue AT&T antitrust case

In a move that would inflame AT&T further, a Justice Department lawyer, Joseph Wayland, Friday requested federal Judge Ellen S. Huvelle to postpone its antitrust case seeking to block the $39 billion acquisition of T-Mobile USA by AT&T Inc. Wayland argued an immediate court proceeding in the matter wasn’t called for now that both companies have withdrawn their application for merger approval at the Federal Communications Commission (FCC), which must also give the nod to the proposed deal. The Justice Department now intends to halt court proceedings, or alternately withdraw its case, until the telcos again seek approval with the FCC. Both had withdrawn the application with the FCC to focus solely on the antitrust fight with the Justice Department. As the Judge too, appears to be agreeing witholding the antitrust proceedings, citing concerns that the companies could alter their deal if and when they reapply with the FCC, AT&T lawyers in court urged Ms. Huvelle to maintain the current trial schedule, stating that the company isn’t playing a strategic game. The judge has instructed the Justice Department to file its motion by Tuesday while setting another court hearing for next Thursday afternoon.
